A's opponent wishes to settle with B out of court.
A's offer is poor and 'first and final offer' accompanied by a no disclosure agreement.
That's difficult because B is owed many hours of overtime by A.
A has been requested to pay B the overtime money. A has placed two small deposits into B's bank account with no explanation. B has requested pay slips without success.
B was willing to settle in November last year but A slammed the door in B's representative's face rendering out of court settlement impossible.
Almost 12 months has passed since the trouble started for B.
B has been living on savings. A's rules rendered it impossible for B to get work elsewhere. because B is prevented from communicating with staff or clients. So no referees can be achieved. B tried to gain employment and failed and B supplied the evidence to B's representative.
As a consequence B has invested considerable sums of money to being able to achieve an income and is still studying to this end. And still living off B's saved money.
A knows that B is innocent.
B knows B is innocent.
B's representative is possibly a bit ? about rejecting the offer and B is thinking "How does this happen?" B is innocent - has been living on savings - and the offer does not restore B to the position B was in before the problem happened. Accepting the offer would leave B worse off financially, reputationally, and still without a job/career.
B's representative needs sound reasons why the offer is poor and to be rejected. AND How to prepare and proceed to the court hearing with winning strategies, case law and an indisputable arguments which win the approval and support of the Head of the court.
B is standing strong and is willing to face a formal court hearing to achieve a better outcome. B needs to speak with a decent solicitor because B is unsure about B's current representative.
